Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Elara, operated by Axient AI Pty Ltd (ABN 21 688 793 151), trading as elaradating (“Elara”, “we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Service.

• You must be at least 18 years old.
• You must be legally able to enter this agreement and not barred from using the Service under any applicable law.
• You must complete identity verification — one real person, one account, your true identity. No impersonation, no accounts on behalf of others.
• You must not have been previously removed from the Service for a serious breach.

Elara is built on real humans — verified through an ID check, or vouched for by people who've actually met them. You agree to provide accurate information, to keep your login secure, and to be responsible for activity on your account. Verification exists to protect everyone — attempting to fake, share, or circumvent it is a serious breach of these Terms.

Elara is one account with four “doors” — Forever, For Now, Tonight, and Friends — that you can open in any combination. There is no swipe: you’re introduced to compatible people on substance, and the app is designed around actually meeting rather than endless messaging. Introductions, scoring, and features may change as we improve the product.

You agree that you will not:

• Harass, threaten, abuse, stalk, or intimidate anyone.
• Post or share content that is unlawful, hateful, sexually exploitative, or involves minors in any way.
• Impersonate anyone, use fake identities, or operate bots or automated accounts.
• Solicit money, run scams, spam, or advertise or promote goods and services.
• Share other members’ private information or images without consent.
• Use the Service for anything illegal, or encourage others to do so.

You can block, report, and unmatch anyone at any time. We operate a community rating system and a three-strikes rule with a right of appeal. Serious breaches can lead to immediate suspension or permanent removal.

Elara verifies identity — but we are not able to run full criminal background checks, and verification is not a guarantee of anyone’s conduct or intentions. You are responsible for your own choices and safety when you meet someone. Please read our Safety page and take sensible precautions: meet in public, tell someone where you’ll be, and trust your instincts.

• Some features (including Elara) are available on paid tiers. Everyone pays the same for the same tier — no boosting, no pay-to-win.
• Paid plans may renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period.
• Prices and inclusions may change; we’ll give notice of material changes before they apply to you.
• Nothing in these Terms limits rights you have under the Australian Consumer Law, including guarantees that cannot be excluded.

You keep ownership of the content you post. You grant us a limited licence to host and display it as needed to run the Service (for example, showing your profile to potential matches). You’re responsible for what you post and confirm you have the right to share it.

The Elara name, brand, software, and content we create are ours (or our licensors’). These Terms don’t give you any right to use them except as needed to use the Service normally.

The Service is provided “as is”. To the maximum extent permitted by law — and subject to any consumer guarantees that cannot be excluded under the Australian Consumer Law — we exclude implied warranties and are not liable for indirect or consequential loss, or for the conduct of other members. Where our liability cannot be excluded, it is limited to the extent permitted by law.

You can close your account at any time. We may suspend or terminate access if you breach these Terms or to protect members or the Service. On termination, the sections that by their nature should survive (such as intellectual property, disclaimers, and liability) continue to apply.

These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that jurisdiction. Before any formal dispute, we ask that you contact us so we can try to resolve it directly and quickly.

We may update these Terms as the Service evolves. If a change is material, we’ll let you know through the Service or by email. Continuing to use Elara after a change means you accept the updated Terms.
